Material from www.rmhc.gr and any other World Wide Web site owned, operated, licensed, or controlled by Ronald McDonald House Charities (Greece) (or any of its licensor, related, affiliated, or subsidiary entities (together, “RMHC”) may not be copied or distributed, or republished, uploaded, posted, or transmitted in any way, without the prior written consent of RMHC.

Without prejudice to the generality of the foregoing, you may download one copy of the material on one computer for your personal, non-commercial home use only, provided you do not delete or change any copyright, trademark or other proprietary notices. Modification or use of the materials for any other purpose violates the intellectual property rights of RMHC. The material in this site is provided for lawful purposes only. If you download software from our site, the software, including all files, images, contained in or generated by the software, and accompanying data (together, the “Software”) are deemed to be licensed to you by RMHC. Neither title nor intellectual property rights are transferred to you, but remain with RMHC, who owns full and complete title. You may not resell, decompile, reverse engineer, disassemble or otherwise convert the software to a human perceivable form.

You bind yourself to use the website and all materials therein contained only for lawful purposes. Without prejudice to the generality of the foregoing, you agree not to use, or otherwise allow or authorise any third party to use the website in any way that is in violation of any law, regulation or guideline in force in Greece or which is in breach of intellectual or industrial property rights. Without prejudice to any rights at law, RMHC retains the right to suspend your access to the website with immediate effect if there is reasonable cause to believe that the provisions of these Terms and Conditions are being contravened.

Restriction of Liability

RMHC and, with regards the online donation (payment facility), our third party electronic payment gateway service provider will endeavour to maintain the website and the online donation (payment facility) online at all times, however you acknowledge and agree that we cannot guarantee an uninterrupted service. RMHC and our third party electronic payment gateway service provider will endeavour to comply with the generally accepted industry standards applicable for the website and to adhere to all applicable legal and regulatory obligations relevant to the website or its donation (payment) functionality.

RMHC and our third party electronic payment gateway service provider will not be liable for any loss or damages or injury, whether direct or indirect, sustained by you or any otherwise affected third party, caused by, including but not limited to, any failure of performance, error, omission, interruption, defect, delay in operation of transmission, computer virus or line failure, technical problems relating to the website, termination of any licence to operate, act of God, failure or shortage of power supply, industrial disputes of any kind, Governmental restrictions or prohibitions, any act or omission of any regulatory or other public authorities or agencies, war, military operations, riots or other disturbances, difficulties, delays or interruptions in the production or supply of equipment used in the service, act or default of any supplier, agent or subcontractor, or any other similar or dissimilar causes beyond RMHC and our third party electronic payment gateway service provider reasonable control.

RMHC and our third party electronic payment gateway service provider will not be liable for any damages or injury, including but not limited to, special or consequential damages that result from the use of, or the inability to use, the materials in this site, even if there is negligence. You agree and bind yourself to indemnify and hold RMHC, its directors, officials, employees, sub-contractors and agents harmless against any liability, loss, damage or injury, whether direct or indirect, arising out of or in connection with your use of the website or any material therein contained, including but not limited to any claim for loss or damage made by any person whomsoever.

Submissions

All remarks, suggestions, ideas, graphics or other information communicated to RMHC through this site (together, the “Submission”) will forever be the property of RMHC. RMHC will not be required to treat any Submission as confidential, and will not be liable for any ideas for its business (including without limitation, product or advertising ideas) and will not incur any liability as a result of any similarities that may appear in future RMHC operations. Without limitation, RMHC will have exclusive ownership of all present and future existing rights to the Submission of every kind and nature everywhere. Except as noted below in this paragraph, RMHC will be entitled to use the Submission for any commercial or other purpose whatsoever without compensation to you or any other person sending the Submission. RMHC’s use and retention of personally-identifiable information you provide to RMHC through this site, including in connection with any Submission, is governed by the RMHC Privacy Policy.  You acknowledge that you are responsible for whatever material you submit, and you, not RMHC have full responsibility for the message, including its legality, reliability, appropriateness, originality and copyright.

Online donations

Please be aware that the use of the online donation facility on this website indicates that you accept these terms. If you do not accept these terms do not use this facility. Please note that in the present sections, any reference to ‘payments’ shall be construed to read as referring to ‘donations’.

We accept most local debit cards and major credit cards. The list of accepted cards and any other authorised donation methods can be viewed on the online payment screen at the time of making a donation. RMHC reserves the right to change the accepted donation methods at any time.

All donations effected are in Euro and are inclusive of any taxes and excise fees unless otherwise stated.

All donations effected through our website shall be accompanied by a receipt.  We do not store receipts and it is your responsibility to ensure that you print and/or keep a copy of the receipt for your records and as proof of donation.

In view of the fact that RMHC may change its Terms and Conditions from time to time, you agree that each donation effected shall be subject to the specific Terms and Conditions in place at the time of the payment. You are responsible to ensure familiarity with and acceptance of the relevant Terms and Conditions as applicable at any point in time.

Processing of donations

All online donations effected through this website are processed using a third party electronic payment gateway (APCO Systems Limited).

The third party electronic payment gateway service provider undertake to take all reasonable efforts to ensure that all online donations are effected using state-of-the-art technology and in accordance with all applicable laws and regulations governing online payments, and this inter alia in order to ensure secure transactions.  RMHC do not have access to your debit/credit card details.

RMHC and our third party electronic payment gateway service provider shall not be liable for any failure of yours to properly protect your data from being seen on the screen by third parties or otherwise obtained by such third parties during the online donation (payment) process. This includes donations (payments) done on public machines or using browsers that do not have the necessary security features in place. Please note that ‘care of’ and temporary addresses such as internet cafes are not accepted for payment purposes.

Personal details provided during online donations (payments) are processed in accordance with our Privacy Policy and the privacy policy of our third party electronic payment gateway service provider.

RMHC and our third party electronic payment gateway service provider undertake to take all reasonable efforts to ensure availability and proper functioning of the online donation (payment) facility. Without prejudice to the foregoing, there may be situations and/or instances when this facility will, for technical or other reasons, be unavailable. RMHC and our third party electronic payment gateway service provider shall in no circumstances whatsoever be held liable for any damages or losses suffered or incurred by you out of the use, inability to use, or the any other circumstance related to the use of this facility.

By using the online donation (payment) facility you automatically and irrevocably consent to your data being in the possession of, retained by, and processed by the third party electronic payment gateway service provider.  You hereby further warrant and agree that any use of the third party electronic payment gateway shall be in accordance with applicable law and hereby fully exonerate and bind yourself to keep RMHC and our third party electronic payment gateway service provider harmless from and against any liability or claim of whatever nature in relation with your use of said donation (payment) gateway.

Amendment, Cancellation and/or Refund Policy

If you have opted for a recurring donation (once it is available), and you wish to amend the amount you donate every month, or cancel it completely we understand. You may do so at any point in time, and the amendment you will make will be effective from the next donation cycle.

Please be aware that due to the nature of the service we offer, we are not in a position to offer a refund after a donation (payment) has been made.  We trust that you agree that the donation (payment) process is simple and transparent, and you, as the user, are free to stop the process at any time before donation (payment) is effected.

A donation may be cancelled and subsequently fully refunded only in cases where the user erroneously makes multiple donations and consequently donations (payments) within the same session at less than ten (10) minutes one from each other. In such cases, the user is requested to send an email to info@rmhc-malta.com within 1 week from the event. Refunds will not be considered after this time. Refunds will be credited back to the original credit card used for donation (payment).

Privacy Policy

RMHC uses its best efforts to protect the privacy of visitors to this website.

Types of Information Collected and How It Is Used

RMHC or our third party electronic payment gateway service provider gather personal information, such as first and last names, home addresses, e-mail addresses, phone numbers, and credit card numbers, only when voluntarily submitted by you. If you make an online donation, personal information will be collected from you in order to process that donation.

Other than as provided in this privacy policy, RMHC does not sell, transfer or disclose personal information to third parties.

Without prejudice to the foregoing, RMHC reserves the right to use or disclose any information as needed to satisfy any law, regulation or legal request, to protect the integrity of the site, to fulfil your requests, or to cooperate in any law enforcement investigation or an investigation on a public safety matter.

Unless mandated otherwise by Legislation, Court Order or similar legally binding instruction, RMHC will keep your data for ten years following which such data will be destroyed.

Access

You are in control of all personal information you provide RMHC or our third party electronic payment gateway service provider online. You shall have the right to require upon due verification, access to your data as well as the right to rectify or, in appropriate circumstances, erase any inaccurate, incomplete or immaterial personal data RMHC or our third party electronic payment gateway service provider process.
